View Full Version : TM Domains
I see lots of .co.nz TM domains here and there, and they are always eventually snapped up.
I am curious, have any of you received any notices and such? I know how it is enforced in the US, but am unsure how much effort NZ companies put into enforcing their IP rights.
:D
Yes NZ companies do enforce their TM's.
I have found this out the hard way by inadvertantly purchasing names that I thought were great only to have the owner of the TM issue me cease and desist orders.
I tend to shy away now, especially as I am sure the DNC would probably begin to look at me in an unfavorable way if I had too many unfair registration submissions.
What experience have others had?
Welcome to the forum tpr2.
especially as I am sure the DNC would probably begin to look at me in an unfavourable way if I had too many unfair registration submission.
DNC is separate to the dispute process, under the DRS (http://www.dnc.co.nz/drs/) (Dispute Resolution Service) policy (http://www.dnc.co.nz/drs/index.php?clsid=1012)
5.3. There shall be a presumption of Unfair Registration if the Complainant proves that the Respondent has been found to have made an Unfair Registration in three (3) or more Dispute Resolution Service cases in the two (2) years before the Complaint was filed.
But of course, you have to get 3 disputes brought and won against you, for this to happen. After that the complainant has less work to prove bad faith.
Hi Zap
Thanks for the welcome and for the help on the domain renewals.
I have had a couple of complaints made to the DRS however I felt they were a bit cheeky and when they went to resolution the arbitrator helped bring the disputes to a happy conclusion.
cheers
