For those not recognising the domain name Groupe Danone owns, among other brands Evian and Frucor who make "V". It registered a NZ trademark on Danone back in 1995 and has been operating in New Zealand under the Frucor name for several years.
Unlike many respondants, the registrant did raise a defence, of sorts. Unfortunately it wasn't (in my opinion) well reasoned and just like the previous reported dispute a comically transparent defence was raised

Although it isn't a defence, "The Respondent further questions why did the Complainant not purchase the Domain Name upon acquiring its New Zealand subsidiary." Now that's a very good question in a different context. If they'd simply registered the name they would have saved themselves the cost of preparing and filing the DRS. They registered frucor.co.nz through Webaddress and they could have had Danone registered there a very long time for the cost of this DRS.
